Terms & Conditions

Please read these terms carefully before using our Site or entering any competition.

Introduction

This website is operated by LuxWinAsia Ltd ("LuxWinAsia", "we", "us", "our"). These Terms & Conditions govern your use of www.luxwinasia.com (the "Site") and your participation in any skill-based competition hosted on the Site. By accessing the Site or entering any competition, you agree to be bound by these Terms & Conditions.

These terms should be read alongside our Game Rules, Privacy Policy, and Responsible Gaming Policy.

Eligibility

Who can enter

You must be 18 years of age or older
You must not be an employee or immediate family member of LuxWinAsia Ltd
You must reside outside our restricted jurisdictions (listed below)

LuxWinAsia reserves the right to request proof of age at any time.

Restricted countries: Cuba, Iran, Venezuela, the Crimean region, North Korea, Myanmar, Belarus, Mali, Germany, and any other jurisdiction where participation in skill-based competitions is prohibited.

Competition Entry

How to enter. Select the number of tickets, correctly answer a skill-based question, and complete payment.

Only one answer may be selected per order; it applies to all tickets within that order
Entry is confirmed only once payment has been received
Ticket purchases are final and non-refundable, except where the competition is cancelled (see Section 7)
The transaction appears as "LUXWINASIA LTD" on your statement

No purchase necessary

A free postal entry route is always available with the same chance of winning as paid entries. See the Game Rules, Section 4B, for the full procedure.

3.6 — Ticket quantities are indicative. Any total or maximum number of tickets shown on a competition page is indicative only.

LuxWinAsia reserves the right, at its sole discretion and without prior notice, to increase, decrease, or otherwise modify the total number of tickets available for any competition at any time. We make no representation that all tickets will be sold, nor that any minimum number of entries will be received before the draw takes place.

Prizes

Each competition prize consists of a premium item or experience as described on the relevant competition page.

LuxWinAsia reserves the right, at its sole discretion, to:

Substitute any prize with an alternative of equivalent, greater, or lesser value
Offer a cash alternative equivalent to ticket revenue
Cancel the competition in full and refund all participants

Prizes do NOT include (unless expressly stated):

Taxes, duties, customs fees, import charges, delivery costs outside the UK, travel insurance, visa fees, passport costs, spending money, vaccinations, maintenance, or other incidental expenses.

Prizes are provided "as is". LuxWinAsia does not guarantee the quality, standard, performance, or suitability of third-party goods or services forming part of the prize.

Winner Selection and Notification

Key timeline

Draws happen within 14 days of the competition's closing date
Winners notified by email within 7 days of the draw
Winners have 5 days to provide proof of identity, age, and ownership of payment method

Draws use a certified third-party random number generator. Tickets are non-transferable — only the original purchaser is eligible to claim the prize.

Failure to provide proof within the 5-day window may result in forfeiture of the prize and selection of an alternative winner.

Winner Publicity

Winners may be required to participate in reasonable promotional activities, including photographs or videos, which may be used by LuxWinAsia in marketing materials.

Winners consent to this use but may withdraw consent in writing prior to publication.

Competition Cancellation and Alternatives

7.1 — Right to cancel or modify. LuxWinAsia reserves the absolute right to cancel, postpone, modify, or substitute any competition at any time, for any reason, at its sole commercial discretion.

This includes (but is not limited to) cases where:

Ticket sales are lower than anticipated
Operational, supplier, or logistical circumstances make fulfilment impractical
LuxWinAsia determines cancellation or modification is commercially appropriate

7.2 — If we cancel in full

All ticket holders are refunded in full. Refunds represent the sole and exclusive remedy available to participants.

7.3 — Alternative options. Rather than full cancellation, LuxWinAsia may exercise any of the options in the Game Rules:

Substitute prize of equivalent, greater, or lesser value
Cash alternative equivalent to ticket revenue
Proceed with draw as published

The purchase of a ticket does not create an enforceable expectation that the advertised prize will be awarded in its original form.

7.4 — Cooling-off rights. Consumer cooling-off rights do not apply to competition entries, as these constitute contracts for leisure activities with a specific date or period of performance.

Chargebacks and Payment Reversals

Entries will be automatically cancelled if any payments are reversed or charged back. Unwarranted chargebacks may result in prize forfeiture and permanent account suspension.

If you have concerns about a charge, contact us at contact@luxwinasia.com before initiating a chargeback. We resolve most issues within 48 hours.

Travel Prize Terms (Conditional)

This section applies only where a prize expressly includes travel components.

All travel arrangements are subject to the terms and conditions of airlines, hotels, and third-party providers. LuxWinAsia is not a party to the contract between the winner and these providers.

LuxWinAsia strongly recommends that winners obtain comprehensive travel insurance. The winner's travel companion must be 18 or older.

Physical Prize Terms (Conditional)

Standard delivery within the UK is included unless otherwise stated. International shipping, customs duties, and VAT are the sole responsibility of the winner.

Manufacturer-supplied items are governed by the manufacturer's standard warranty terms.

Ambassador & Affiliate Disclosure

LuxWinAsia operates an Ambassador Program that pays commissions to participants who refer new customers. Ambassadors who promote our competitions on social media or other channels are required to clearly disclose the commercial relationship in line with the UK CAP Code and ASA guidance — for example, using #ad or #affiliate tags.

Commissions are paid only on completed, non-refunded purchases by referred customers, and only after the cooling-off and chargeback windows have elapsed. Full Ambassador Terms are available in the Ambassador Program section of the Site.

Acceptable Use

You may use the Site only for lawful purposes. You agree not to reproduce any part of the Site, attempt unauthorised access, transmit viruses, use automated tools (bots, scrapers), or send unsolicited advertising.

Intellectual Property

All content on the Site is owned by LuxWinAsia Ltd or its licensors. You may view and use the Site for personal, non-commercial purposes only.

Limitation of Liability

Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by English law.

LuxWinAsia is not liable for indirect, incidental, special, consequential, or punitive damages.

Disclaimer

Information on the Site is for general informational purposes only. We make no representation or warranty regarding accuracy, reliability, or completeness.

Account Use

Accounts are for personal use only and are non-transferable. You must keep your login credentials confidential and notify us immediately of any suspected security breach.

Complaints

If you have any complaints or concerns, please contact us at contact@luxwinasia.com. We will acknowledge your complaint within 5 business days and aim to resolve it within 14 business days.

Changes to These Terms

LuxWinAsia reserves the right to update these Terms at any time. The terms applicable to your competition entry are the version in effect at the time of your purchase.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
