Terms & Conditions

This website is operated by Premium Trip Ltd, trading as "LuxWinAsia" ("LuxWinAsia", "we", "us", "our"). These Terms & Conditions govern your use of www.luxwinasia.com (the "Site") and your participation in any skill-based competition hosted on the Site. By accessing the Site or entering any competition, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site or enter any competition.

These terms should be read alongside our Game Rules, Privacy Policy, Acceptable Use Policy and Refund & Cancellation Policy, which together form the agreement between you and LuxWinAsia.

LuxWinAsia.com is a trade name of Premium Trip Ltd.

2.1. Participants must be 18 years of age or older. We reserve the right to request proof of age at any time, including upon winning.

2.2. Employees of Premium Trip Ltd, their immediate family members, and anyone professionally connected to a competition are not eligible to participate.

2.3. Participants are responsible for ensuring that their participation complies with the laws of their country of residence.

2.4. Entrants from restricted jurisdictions are not eligible (including Cuba, Iran, Venezuela, the Crimean region, North Korea, Myanmar, Belarus, Mali, Germany, and any jurisdiction where skill-based competitions are prohibited). Entries from restricted jurisdictions will be refunded.

3.1. To enter, participants select the number of tickets they wish to purchase, correctly answer a skill-based question, and complete payment. One answer may be selected per order, and that answer applies to all tickets in the order.

3.2. Entry is confirmed only once payment has been received and acknowledged by LuxWinAsia. We are not responsible for incomplete, delayed, or unreceived entries.

3.3. All ticket purchases are final and non-refundable, except where a competition is cancelled by LuxWinAsia (see Section 7).

3.4. Each competition closes on the date specified on the Site or when all available tickets are sold, whichever occurs first.

3.5. Upon successful payment you will receive a confirmation email. The transaction will appear on your bank or card statement as "PREMIUM TRIP LTD".

4.1. Each prize is a luxury travel package as described on the relevant competition page. Unless otherwise stated, prizes include return flights for two (2) persons and accommodation at a 5-star hotel for the duration specified.

4.2. The exact components of each prize (destination, travel dates, duration, airline, hotel and inclusions) are set out on the competition page. Where exact dates are not specified, travel arrangements will be agreed between LuxWinAsia and the winner within the parameters described.

4.3. Unless expressly stated, the prize does NOT include: travel insurance, visa or passport costs, vaccinations, meals or activities outside the stated package, spending money, excursions, or any other incidental expense. These remain the sole responsibility of the winner.

4.4. Travel dates are subject to availability with airline and hotel partners and may be subject to blackout periods (peak seasons, public holidays). We will make reasonable efforts to accommodate the winner's preferred dates.

4.5. LuxWinAsia reserves the right to substitute any prize with an alternative of equivalent or greater value. No cash alternative is offered unless expressly stated.

4.6. Prizes are provided "as is". We do not guarantee the quality or suitability of third-party services forming part of the prize (airlines, hotels, transfer operators).

5.1. Winners are randomly drawn from all correct entries within fourteen (14) days of the closing date, using a certified third-party random number generator. A draw certificate is available on request.

5.2. Winners are notified by email within seven (7) days of the draw and must confirm acceptance within five (5) days.

5.3. Upon winning, we will request proof of identity, proof of age, and proof of ownership of the payment method used. Proof must be provided within five (5) days of notification. If the payment method was not legally owned by the winner, written authorisation from the cardholder is required.

5.4. Travel arrangements must be agreed within fourteen (14) days of prize confirmation.

5.5. Failure to meet any of these timeframes may result in forfeiture of the prize and selection of an alternative winner. Tickets are non-transferable.

6.1. Winners may be required to take part in reasonable promotional activity (photographs, video, testimonials) for use in our marketing across various channels.

6.2. Winners may withdraw this consent in writing prior to publication. Promotional materials created in connection with the competition become the property of Premium Trip Ltd.

7.1. LuxWinAsia reserves the right to cancel any competition at its sole discretion.

7.2. If a competition is cancelled, all ticket holders are notified by email and a full refund is issued to the original payment method. Full details are set out in our Refund & Cancellation Policy.

7.3. Consumer cooling-off rights do not apply to competition entries, as these constitute contracts for leisure activities with a specific date or period of performance, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

8.1. Entries are automatically cancelled if any payment is reversed or charged back.

8.2. Unwarranted chargebacks may result in forfeiture of prizes and permanent suspension of accounts, and may make a participant ineligible for future competitions.

8.3. If you have any concern about a charge, please contact us at contact@luxwinasia.com before initiating a chargeback.

9.1. All travel arrangements forming part of a prize are subject to the terms of the relevant airline, hotel and third-party providers. LuxWinAsia is not a party to the contract between the winner and these providers.

9.2. LuxWinAsia is not liable for cancellations, delays or disruptions caused by airlines, hotels or other third-party providers.

9.3. If a travel component becomes unavailable due to circumstances beyond our reasonable control (route cancellations, hotel closures, natural disasters, pandemics, government travel restrictions, political instability), we will make reasonable efforts to provide a suitable alternative, or at our discretion offer a substitute prize of equivalent value.

9.4. The winner and their travel companion travel at their own risk. We strongly recommend comprehensive travel insurance covering cancellation, medical expenses, personal liability and lost luggage.

9.5. Both the winner and their companion must hold valid passports with at least six (6) months' validity from the date of return travel, and all required visas and vaccinations. The companion must be 18 or older unless the competition page states otherwise.

9.6. Winners outside the United Kingdom are responsible for any applicable taxes or duties arising from receipt of the prize.

All content on the Site (text, images, logos, graphics, software) is owned by Premium Trip Ltd or its licensors and is protected by intellectual property laws. You may use the Site for personal, non-commercial purposes only. Any other use requires our prior written consent.

11.1. Nothing in these terms excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under English law.

11.2. We are not liable for any indirect, incidental, special or consequential loss arising from your use of the Site or participation in any competition, including loss of profit, revenue, data or goodwill.

11.3. We are not liable for losses where there is no breach of a legal duty owed to you, where the loss was not reasonably foreseeable, where it was caused by your own actions, or where it relates to your business use of our service.

Accounts are for personal use only and are non-transferable. Keep your login credentials confidential and notify us of any suspected breach. We may suspend or terminate your account if we reasonably believe you have breached these terms.

We may update these Terms & Conditions at any time by posting a revised version on the Site. The terms applicable to your entry are those in effect at the time of purchase.

14.1. These Terms & Conditions are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

14.2. Consumers residing in the EU or other jurisdictions may benefit from mandatory consumer protection provisions of their local law, which these terms do not override.
